A petition has been filed for criminal charges against Controller of Budget Margaret Nyakang'o to be dismissed.
Respondents in the petition filed by Nyamira Member of Parliament Stephen Mogaka are the Directorate of Public Prosecutions (ODPP) and the Directorate of Criminal Investigation (DCI).
The petitioner claims that Nyakang'o's arrest and arraignment violated her constitutional rights.
"The arrest comes in the wake of her public exposes with regards to the fiscal improprieties within the running of various state arms and agencies and is a manifestation of a knee-jerk reaction with ulterior motive," he claims in the court papers.

In the court papers, the legislator requests that the Inspector General of Police, DCI, and DPP refrain from investigating and prosecuting her.
A 2016 criminal case is at the heart of her problems, with Nyakang'o and 11 others facing fraud-related charges.
After her arrest on Tuesday, she was released on a Ksh.2 million bond with the option of a similar surety or Ksh.500,000 in cash.
On Tuesday, November 5, she pleaded not guilty to four charges in a Mombasa Court, where she was one of 11 people charged with conspiracy to defraud, operating an unlicensed Sacco, forgery, and uttering false documents.
The charges stem from an investigation launched by the DPP and turned over to the DCI.
According to the inquiry file, Nyakang'o and the ten others were found guilty after a thorough examination of new evidence.
