Ten Machakos County officers involved in the dramatic assault on Kalama Ward MCA Boniface Maeke on Wednesday have been detained.
They are James Mwendwa Muindi, Albanus Muli Maluki, Joshua Kitolo Mutiso, David Ouma Otieno, Cliff Benson Kimeu, Simon Musembi Ndeto, Bonface Kioko Musyoka, Evans Mwambi Muthenya, Alex Wambua Musembi, and Jeff Musyoki Mutangili.
In a miscellaneous motion submitted by the Machakos DCI on Thursday, the prosecution requested that the officers be prosecuted with robbery with violence and assault, among other crimes, for inflicting physical damage on MCA Maeke.
The applicant, DCI Kathambi Nancy Mumma, also requested that the county askaris be detained in the Machakos Police Station for 14 days pending the conclusion of investigations.
“The applicant is undertaking investigations in relation to an offense of robbery with violence contrary to section 296(2), assault causing actual bodily harm Contrary to Section 251, and creating a disturbance in a manner likely to cause a breach of peace Contrary to Section 95(1)(b) of the penal code,” read the affidavit.

“I, therefore, pray that this honorable court authorize the detained persons of interest at Machakos Police Station for 14 days pending the conclusion of the investigations.” it added.
Mumma claims that releasing the suspects may interfere with investigations because some of their collaborators may still be on the run, and an identification parade has yet to be held.
She said, "The identification parade has not been conducted, witness statements have not yet been recorded, and if the respondents are released, they might interfere with the investigations.
"Mumma videotaped the suspects stripping the MCA naked and injuring his left leg, ankle, hand, ribs, and private areas.
They also allegedly stole Ksh.100,000 from his wallet at the time and a Samsung mobile phone worth Ksh.150,000.
