The case against former Sports CS Rashid Echesa in the Ksh.39 billion fake arms case has been pushed to a later date after Echesa failed to appear in court.
Echesa failed to show up in court over claims that he was in mourning. Two of his co-accused who appeared in court on Monday were required to post cash bail to be released until the case outcome.
Judge Kanyi Kimondo determined that the prosecution had presented a solid evidence against Echesa, and that the trial court should have found him with a case to answer, requiring him to defend himself rather than acquitting him and remanding the matter for trial.

Last Monday, the High Court in Milimani overturned Echesa's acquittal in the Ksh.39 billion fake arms case.
The judgment was delivered by High Court Judge Kanyi Kimondo, who stated that the trial magistrate erred in acquitting Echesa since certain witnesses did not testify.
Judge Kimondo determined that the prosecution had made a compelling case against Echesa and that the trial court should have given him a case to answer, requiring him to defend himself rather than acquit him.
