The DPP claims in his affidavit that Matiangi claims that the DPP and the president met during the conference to plan against him, adding that this is perjury and that he will hold him accountable for providing evidence that the meeting occurred.

In his affidavit, Matiang'i stated that he received information that the plan to have him arrested was devised during the 16th Annual General Meeting and Africa Prosecutors' Association (APA) Conference, held in Mombasa. According to the former interior secretary, his family home in Karen was raided, surrounded, and cordoned off by police officers looking to arrest him on the afternoon of February 9. According to him, the police surrounded his house and only left after the media arrived and word of their presence spread on social media.

Matiangi's lawyer, danstan Omari, who arrived during the incident, said that his client's life was at risk and accused the police of harassment. He added that the reason for the raid at that time of the night is still unknown and that his client has not committed any offence but that he is ready to respond to the summons if they have evidence that he has a case to answer.
