The high court has rejected the pokot south member of parliament David Pkosing's application for anticipation bail.
Pkosing, through his lawyer Danstan Omari, had applied to court last Friday for an order to stay his alleged imminent arrest until the outcome of his application. In the application filed before Lady Justice Diana Mochache at the Milimani Law Court, he named the DCI, the Inspector General of Police, and the Director of Public Prosecutions (DPP).
The pokot south mp is accused of being behind bandit activities in the north rift region, an allegation that the pokot mp has denied terming the allegations as farfetched and baseless. The lawmaker said that after his release, he was told to return to the DCI headquarters the next day at 8 a.m., which he did, only to be dismissed and told to return the next day at 4:30 p.m. to respond to money laundering allegations.
"...the Applicant has never received any other summons requiring him to attend to any police station or investigative agency. He is thus apprehensive that the intent of requiring him to attend the DCI offices at 4.30 p.m. on a Friday is to lock him up till Monday next week arbitrarily," stated lawyer Omari in court papers.
"Further, the news of his imminent arrest was widely circulated and reported by various media houses and on social media platforms and he is apprehensive that the Kenya Police will raid his home and arrest him."
The Lady Justice also scheduled a hearing on the application for February 23, 2023, at three p.m.the pokot south mp maintains that his arrest and the accusations are a witch hunt because of his political affiliation with the azimio coalition la Umoja coalition.
His lawyer, danstan omari is also facing legal troubles of his own after being summoned by the DCI to answer questions regarding the alleged raid at his client's house
