The Kenya Civil Aviation Authority's (KCAA) Government house worth Ksh.52M, which was grabbed in the Nyali estate, has been recovered by the Ethics and Anti-Corruption Commission (EACC). The fraudulent acquisition of the property was aided by ex-Commissioner of Lands Sammy Mwaita, according to the EACC.
Lady Justice Nelly Matheka of the Mombasa Environment and Land Court, in her judgment, determined that the land parcel had originally been set aside for KCAA staff before it was grabbed by Luka Kimutai and his spouse Sally Jepkpoech Cheptoo.
The land parcel, which includes a 4-bedroom bungalow and a servant quarter, was found to have been irregularly acquired by Luka Kimutai. Lady Justice Nelly Matheka declared the allocation of the property to be fraudulent, illegal, and null and void. As a result, she ordered the cancellation of the title and all entries made in the land register in favor of Luka Kimutai.
This case in Nyali is just one of many recovery suits currently pending before various courts in Kenya, where the EACC is seeking orders to force those who illegally own public property to surrender it back to the public. These recovery suits amount to over Kes.40 Billion in total.
