Member of Parliament for Embakasi East, Babu Owino, has sought the court to clear him of the criminal accusations he is facing.
The legislator was determined to have a case to answer when he was accused of firearms misuse.
According to Owino, the prosecution has failed to establish its case beyond a reasonable doubt. He claims that Throughout the case, none of the witnesses did testify to the fact that he was disorderly because none of the witnesses saw the accused him behaving in the alleged disorderly manner.
The MP claims that the prosecution failed to prove that he was unruly while carrying a pistol because none of the witnesses could agree that the accused was disorderly.

"We most humbly submit that the prosecution has failed to establish beyond a reasonable doubt that the accused person is guilty." To put it another way, the prosecution case is "scandalous, frivolous, vexatious, and an abuse of the court process," according to Owino.
According to Owino, none of the prosecution witnesses, including the victim DJ Evolve, have demonstrated that he had his pistol at the time of the incident.
He claims that the allegations that he was drunk on the material day are unsupported by any toxicological report and are only allegations on which the prosecution must prove that he was drunk, causing him to conduct disorderly.
A few weeks ago, DJ Evolve denied seeing the politician with a gun during an incident that left him paralysed. The DJ testified virtually from his bed, saying he had no idea what happened to him because he only found himself in an ambulance.
