Former Chief Justice Willy Mutunga has observed that goons who have been reported destroying property and attacking people during demos could be paid police agents.
Speaking on Monday, the CJ noted that demonstrations are always peaceful until the police show up.
Further, he claimed that goons could be the police who are paid to cause chaos and organisers blamed for the aftermath.
"The state does resurrect its private militia to do its bidding. The so-called goons could be police agents paid to destroy property. The organizers of the demonstrations are then blamed," he said.

However, he noted that it is the duty of the government to protect the lives and properties of Kenyans.
"That’s why it’s foolish to blame the demonstrators for resurrecting goons! Is it not the duty of the police to stop them immediately?"
His comments were made amid nationwide demonstrations spearheaded by the leader of the opposition, Raila Odinga.
Azimio declared on Friday that the protests will start this week on Mondays and Thursdays at 6 am and stop at 6 pm.
Azimio's second demos were accompanied by a series of tumultuous situations that rocked Kibra.
Tyres were torched across the road in Kibra.
To disperse the young protesters, police had no choice but to fire tear gas canisters.
