Joy Garden Primary School's two directors and three instructors, who were detained after a student died, can now return to the school.
This comes after the court reversed its previous orders prohibiting them from visiting or going near the facility in Nairobi's Umoja-Tena region.
The five are Jane Waithera Kimani, James Mungai Gachimo, Caroline Nthio Matheka, Anthony Mwangi Kimani, and Vanice Kerubo Bosire.
At the same time, the court will rule on whether Antony Mwangi Kimani would be granted a passport to allow him to travel outside of the jurisdiction. Kimani applied to get her passport released to go to the UK.
However, the prosecution contested the application, claiming that investigations were still underway and the passport should not be released.
The five were detained after a Grade 8 child died strangely, with the school stating he fell from the seventh story of the building that houses the school. Lawyer Danstan Omari represents them.
However, Wesley Njiru's family has contested the school's allegation that their son died as a consequence of a fall.
