The High Court has issued orders preventing the police from arresting or detaining two MPs as part of the investigation into the funding of the Gen Z protests.
Embakasi North MP James Gakuya and Embakasi Central MP Benjamin Mejja Donk were taken from Parliament buildings on July 31 and questioned regarding the matter.
Both MPs are allies of Deputy President Rigathi Gachagua.
Additionally, other Gachagua allies, including three aides, have been questioned about funding the protests.
Gakuya and Mejja Donk have since moved to court to stop their arrest in relation to the investigation.
Justice Chacha Mwita has issued orders stopping the arrest and detention of the two lawmakers. Further directions will be provided on September 17.
"That in the meantime, a conservatory order is hereby issued restraining the respondent, their agents or servants from arresting, detaining, confining, pursuing and or in any other way interfering with the petitioner's liberty in connection with the allegations giving rise to this petition," Justice Mwita said in the orders dated August 5, 2024.
