The Law Society of Kenya (LSK) and the Kenya Human Rights Commission (KHRC) have been granted permission to file a judicial review against the Kenya Airports Authority’s (KAA) decision to lease Jomo Kenyatta International Airport (JKIA) to the Adani Group.

Justice J. Chigiti, presiding over the Milimani court, issued a conservatory order, effectively suspending any further actions related to the proposed 30-year lease until the case is resolved.

This ruling is seen as a significant victory for critics, including the Kenya Aviation Workers Union, which has vehemently opposed the lease to the foreign entity.

The case registered as HCJR/E199/2024 has been fast-tracked due to its urgency and will be heard even during the court's recess period. The LSK and KHRC argue that the decision to lease Kenya’s main airport lacked transparency and public consultation.

The Kenya Airports Authority and other parties involved must respond to these claims in the coming days.

The case raises significant concerns regarding national sovereignty and job security. A final ruling will determine whether the lease will proceed or be terminated. The case is scheduled for mention on October 8, 2024.
