The High Court in Eldoret will determine if Francis Simiyu, the former CEO of the Christian Health Association of Kenya (CHAK), will be granted his request to be awarded Kes 5.9 billion by the government for wrongful detention 41 years ago on December 6, 2024.

High Court judge Justice Reuben Nyakundi gave the parties involved in the matter 14 days to file their submissions before the set judgment date.

Simiyu filed the case against the Attorney General, Inspector General of Police, and the Director of Public Prosecution (DPP) through his lawyer Francis Omenya at the High Court three years ago.

Simiyu wants the court to award him the Kes 5 billion claiming malicious arrest, prosecution, conviction and sentencing in connection with theft of more than Kes 3 million from his employer.

The Chief Magistrate's Court in Nairobi sentenced him to 3 years in jail 41 years ago after he was found guilty of stealing money from his employer.

Unsatisfied with the ruling at the law court, Simiyu filed an appeal before the High Court in Nairobi to quash the jail term, accusing the state of malicious prosecution, wrongful arrest, and detention.

However, by the time his appeal went through, Simiyu had already served his sentence.

Simiyu then moved to the Court of Appeal, where he was vindicated of his employer's charges against him.
