In a case where former Treasury Cabinet Secretary Henry Rotich and others have been accused over the Ksh.63 billion Arror and Kimwarer dams scandal, the prosecution has once again failed to call its witnesses to the stand.

On Monday, the prosecution informed the court that it would take at least 14 days for the new Director of Public Prosecutions (DPP), Renson Ingonga, to settle into his position and provide guidance on the case.

"Last week, the DPP was sworn in. I won't get weary of asking for the result. Permit me to ask for 14 days so that he may sit down and provide guidance on the case, the main prosecutor said in a statement before Magistrate Eunice Nyutu.

The magistrate ordered the witnesses to testify despite noting that the DPP had the right to request a review but claimed that the request for an adjournment was unjustified.


The two witnesses who were scheduled to appear on Monday morning, according to the prosecution, were not the subject of any questions. The case was continued for a hearing on Tuesday.

On October 19, the court will rule on an application by the prosecution asking that trial magistrate Nyutu be disqualified from hearing the case.

The application has been filed by the prosecution.
