Kiambu High Court has dismissed a petition seeking to stop the documentation processes that include the issuance of title deeds for a project jointly undertaken by Finsco Africa and Legacy Ridges.

Lady Justice Abigail Mshila upheld a preliminary objection dated May 11, 2023, thus clearing a major hurdle for the project.

“The application is found to be incompetent and it is hereby struck out,” read the ruling.

The Legacy Ridges project in Kiambu County, where developer Finsco Africa had requested a court order to differentiate between commercial and succession issues, was the focal point of the legal dispute.

The developer had raised in court the need that real estate businesses be protected from lawsuits that seek to halt the legal company entities' processes as outlined in the company's Act because of specific individuals' objections.

The petition was fiercely contested by Wamikey Estate Ltd. and sixteen other respondents, who deemed it misguided.

Affordable housing is being built in Legacy Ridges as part of Finsco Africa's mixed-use development project.

Mostly intended toward low- and middle-class income earners, this massive project spans 100 acres in Ruiru Town, off the Thika Super Highway across from Nova Pioneer Girls.
