A woman who had been detained after being discovered in possession of 80 liters of the drug in Gem, Yala sub-county, was released after the Siaya Magistrate's Court declared that possessing "kangara" is not illegal.

According to prosecutor Peter Kubebea, "kangaroo" is prohibited since it is a component of the illicit liquor substance "change."

Petronila Ayuma was released when Magistrate Jacob Mkala declared that although "kangaroo" is a component of change, it is not a prohibited good in and of itself.


According to the magistrate's ruling, it is impossible to prosecute someone for possessing a good that isn't against the law in Kenya.

According to him, someone can only face charges if they are discovered possessing the illegal substance chang'aa.

Regarding whether or not the "kangara" should be destroyed, the magistrate stated that since it was not an illegal product, the court could not order the police to destroy it.

Consolata Awuor was found guilty by the same court of possessing three liters of chang'aa and was given a community service sentence.
