Actor Jamie Foxx is accused of sexual assault and battery in a case that was submitted to the New York State Supreme Court on Monday.

The CNN complaint states that the alleged incident happened in 2015 at Catch NYC, a well-known restaurant in New York City.

CNN has contacted the plaintiff's attorney and Foxx's representatives.

Foxx "intentionally and without consent used force to offensively touch Plaintiff's person," including prodding her breasts and genitalia, according to the plaintiff, Jane Doe, who is named in the lawsuit. According to the complaint, Foxx appeared to be "intoxicated" at the scene.


Consequently, the complaint claims that the woman has experienced and is still experiencing "physical and emotional injuries, anxiety, distress, embarrassment and economic harm" and requests an amount that has not been specified.

The restaurant's parent company, Catch Hospitality Group, and several other connected companies, are being sued by the plaintiff for negligent hiring, training, and supervision.

It was not immediately possible to reach a company representative for comment.

The lawsuit was brought by the Adult Survivors Act of New York, which went into force in late November 2022 and permits adult victims of sexual abuse to bring legal action against their abusers in New York, even after the statute of limitations has passed.


The statute, which gives adult survivors of sexual assault a year to sue their attackers, is about to expire this Friday.

Following his hospitalization in Atlanta for an undisclosed medical condition earlier this year, Foxx experienced a medical episode. In July, the Oscar winner talked about his recovery for the first time.
