**Court of Appeal Dismisses Interim Stay Bid by Jubilee Party Rebel Faction**
The Court of Appeal has rejected an attempt by a faction of Jubilee Party officials to challenge the leadership of retired President Uhuru Kenyatta.
In a ruling delivered on November 19, 2024, the court declined to grant interim stay orders sought by Cherangany MP Joshua Kuttuny, East African Legislative Assembly (EALA) MP Kanini Kega, and the Party’s Disciplinary Committee. The faction aimed to counter a September decision by the Nairobi High Court that upheld Kenyatta’s position as party leader.

High Court Judge Justice Mulwa had nullified actions taken by the Kanini Kega-led group, citing procedural irregularities. Specifically, the judge ruled that a notice issued by the faction in February 2023 was improperly executed, invalidating subsequent resolutions, including the suspension of senior officials Jeremiah Kioni, David Murathe, and Kagwe Gichohi during a National Executive Committee (NEC) meeting on February 10, 2023.
The High Court further overturned an earlier decision by the Political Parties Dispute Tribunal, which had backed the Registrar of Political Parties’ recognition of changes made during the disputed NEC meeting.
In response, Kuttuny and Kega sought relief from the Court of Appeal. However, a bench comprising Justices Jamila Mohammed, Mumbi Ngugi, and F. Ochieng declined their application for interim orders, indicating that a decision on the matter would be delivered on March 7, 2025.
