A Nairobi court has ordered the release of businessman Ben Gethi, former PS Peter Mangiti, former NYS Director General Nelson Githinji, and other parties in connection to the Ksh 791 million NYS scandal.
The court, however, ruled that businesswoman Josephine Kabura and four others have a case to answer concerning the missing funds.
On Monday, trial magistrate Wendy Micheni ruled that the prosecution had failed to produce sufficient evidence to link them to the crime.

According to the magistrate, the prosecutor relied on broad information not corroborated by electronic or documentary evidence.
"Having failed to establish a prima facie case against the accused persons, i hereby acquit them for lack of evidence," the court said.
The prosecution called more than 50 witnesses to testify against Mangiti and others. The accused disputed the claims of conspiracy and money theft in 2015.
