Former First Lady Mama Ngina Kenyatta and Ex-Taveta MP Basil Criticos have moved to court over Taita Taveta land measuring 1062.3 hectares.
They have sued the Chief Lands Registrar and the Attorney General for allegedly failing to issue them a Certificate of Title for the land in the case.
They now request that the court order the lands registrar to provide them with the original Tittle Land Reference LR No. 10287/7 Taveta certificate, claiming they are the property's registered owners.
“The applicants are the joint operators and owners of the parcel of land known as LR No. 10287/7Taveta …….,”reads court papers.
They contend that they have not received the Certificate of Tittle from the registrar.

The pair claims that they were the registered owners of the land as joint proprietors previous to its subdivision.
However, after a while, the parties split up the land and moved the subdivisions, each receiving a certificate of title upon registration.
“It is now over one year since the property was registered under the provisions of the land registration act, and the registrar has failed to issue to the applicants the said certificate of title,” argue the applicants.
They argue that failure to be issued with the certificate has denied them the right to hold the said certificate as evidence of proprietorship of their said parcel of land.
“The registrar is the custodian of the said documents and is the only person to explain why the applicants have been denied their said certificate of title,” they say.
The matter has been satisfied as urgent the two granted leave to challenge the issues raised and are to serve their motion within 14 days.
The matter will be mentioned march 5 to report compliance.
