Robert Mbui, a member of Parliament from Kathiani, has criticized the High Court's decision to hire new commissioners for the Independent Electoral and Boundaries Commission (IEBC).

Judge Mugure Thande of the High Court directed the selection panel to continue the process, stating that the bipartisan talks committee's political ceasefire does not supersede the Constitution.

Mbui contested the court ruling during a panel discussion on Citizen TV on Monday, claiming it would give the Kenya Kwanza coalition party more influence than the other parties.

"For a judge to make a decision and say that 'proceed' it means that already the 2027 election is predetermined. That is what we are fearing," said Mbui.

The MP emphasized that the three branches of government must respect one another and that the court should refrain from making decisions on issues that are up for debate in Parliament.

"One of the deliberations from the NADCO report was to tell the selection panel to stop and await the outcome of the process that brought all these players together," he said. 

Ledama Ole Kina, a senator from Narok, stated on the same platform that Azimio is dissatisfied with the High Court's ruling.

As a result of the High Court's ruling, Ledama stated, "We have an option. We move to the court of appeals and present evidence that this is a matter that is alive in Parliament that is trying to bring a balance on the players and also community order."


On February 1st, the High Court ruled that the IEBC selection process would start immediately.

Justice Mugure Thande ruled, "I reject the notion that the political question doctrine should override the very explicit constitutional provisions and that the prevailing circumstances should be allowed to infringe on the rights enshrined in the Constitution. "

According to constitutional lawyers, the nation is experiencing a constitutional crisis because the IEBC is supposed to begin and finish delineating borders by the end of this month.

Raila Odinga, the leader of the Orange Democratic Movement (ODM) party, has also criticized the High Court's decision.

"That is untrue. We are unable to discuss the IEBC until Wandayi and Kalonzo's report has been approved by Parliament. Regarding the cost of living, we continue to demand a reduction," Odinga stated on Sunday.
