The appointment of Anthony Mwaura as Chairman of the KRA Board has been declared illegal and unconstitutional. High Court Judge Francis Gikonyo revoked Mwaura's appointment, stating that national values and integrity were not adhered to during the process, making it inconsistent with the constitution.

Judge Gikonyo emphasized that criminal charges, including corruption and economic crimes, are relevant when assessing integrity. He noted, "Conviction of an offense is also crucial for testing integrity. Failure to disclose conflicts of interest related to the office you hold or are appointed to is relevant material for testing integrity."


The judge pointed out that public trust is essential for public officers, and the fact that Mwaura was facing corruption and economic charges—which are still pending—undermined this trust. He also dismissed Mwaura's argument that there were no impediments to his appointment at the time, stating it was indefensible.

Judge Gikonyo highlighted the importance of national values and principles of governance outlined in Article 10 of the constitution. He supported petitioner Dr. Benjamin Gikenyi's claim that Mwaura's appointment was inconsistent with the law, stating, "The country should focus on building a culture based on national values, integrity, and leadership principles."
