The Directorate of Criminal Investigations (DCI) has recommended that five individuals be prosecuted for allegedly organizing and financing the June youth-led anti-government protests.
In a letter dated September 26, the DCI requested the Directorate of Public Prosecutions (DPP) to take action against two MPs—Benjamin Gathiru Mwangi (Embakasi Central) and James Mwangi Gakuya (Embakasi North)—among others.
According to intelligence reports, these individuals were linked to meetings held at Hotel Boulevard in Nairobi that are believed to have been pivotal in coordinating the protests.

The DCI stated that both MPs were summoned on July 31, 2024, and had their statements recorded. However, they refused to hand over their mobile phones for forensic analysis.
The investigative agency is pushing for the five, including George Theuri (Embakasi West), Martin Deric Ngunjiri Wambugu (Nyeri), and Pius G. Munene, to be charged with conspiracy to commit a felony under section 393 of the Penal Code.
In addition, the DCI is seeking specific charges against Benjamin Gathiru Mwangi for soliciting or inciting others to commit an offense under section 391 of the Penal Code and for involvement in money laundering under the Proceeds of Crime and Anti-Money Laundering Act, sections 3, 4, and 7.
The DCI is working with the Financial Reporting Centre (FRC), Safaricom, and banks to further the investigation and obtain financial records related to the alleged transactions used to fund the protests.
