The Kitui High Court has declined to hear a petition from two Wiper party County Assembly members challenging Prof. Kithure Kindiki's nomination as Deputy President. The petition, filed by Ikanga ward MCA Cyrus Musyoka and nominated MCA Priscillah Martha Mukami, both from Kitui, has instead been referred to a three-judge bench led by Justice Eric Ogola at the Milimani Law Courts in Nairobi, which is handling consolidated impeachment petitions.
On Thursday afternoon, the bench will decide whether to extend or lift the conservatory orders initially issued by Justices Chacha Mwita of Milimani and Richard Mwongo of Kerugoya, which halted the Senate's impeachment of Gachagua and barred Kindiki from taking up the role of Deputy President.
Gachagua's lawyer, Kibe Mungai, argued that "a process conducted by the legislative arm of the State has been converted to a Government Project."
On Thursday morning, the Court of Appeal is set to issue directions on Gachagua's appeal against the ruling by the three-judge bench that deemed Deputy Chief Justice Philomena Mwilu’s empanelment of the impeachment bench lawful.
Addressing mourners at Geoffrey Murugami's funeral in Limuru, Kiambu County, on Wednesday, impeached Deputy President Rigathi Gachagua expressed confidence in the Judiciary's impartiality and commitment to justice in his case. "I urge everyone to remain calm as we await the outcome of these proceedings. I trust the Judiciary will uphold the principles of a fair hearing," he said.
