Hendrick Nyongesa, a former head of procurement at the National Youth Service (NYS), has been sentenced to seven years in prison for falsifying a document, in violation of Section 347(a) and Section 349 of the Penal Code. Additionally, he received a five-year sentence for breach of trust as a public service employee, as per Section 127(1) and Section 127(2) of the Penal Code. Both sentences will run concurrently with no option for a fine.


In a related ruling, former NYS finance director Samuel Wachenje was also sentenced to five years in prison without a fine option.

The two were recently convicted of conspiring to defraud NYS of Ksh.791 million. The court was told that Nyongesa, along with others not present in court, created a forged document to misrepresent a Ministry of Public Works Supplies Branch circular as authentic. The court found that between December 1, 2014, and June 5, 2015, Wachenje and Nyongesa breached their public service roles by authorizing payments that resulted in significant financial losses for NYS.
