The ruling on whether former Migori Governor Okoth Obado and two co-accused will face trial is scheduled for January 30, 2025. This decision comes after final submissions from both sides, with Obado’s defense arguing that the prosecution did not present a strong case.
Obado’s lawyers, Kioko Kilukumi and Rodger Sagana, argued that he had an open relationship with Sharon Otieno and had expressed willingness to support her and their unborn child. The defense also claimed that charging for murder in connection with a foetus has no legal basis, as murder charges apply only to individuals born alive.
Co-accused Michael Oyamo and Caspal Obiero, through their legal representatives, also requested acquittal, arguing that prosecution witnesses provided false testimonies and that the evidence presented was insufficient for conviction. Oyamo’s lawyer specifically disputed a witness’s claim, stating, "It’s unrealistic for someone to jump out of a moving vehicle into traffic and sustain only bruises," suggesting that such an incident would likely cause serious injuries or death.
