A university student, David Oaga Mokaya, is set to face a full trial over accusations of publishing misleading content online. The case involves an image of a funeral procession that Mokaya allegedly shared with a deceptive caption.

The trial will proceed as the court confirmed that the Director of Public Prosecutions (DPP) has not issued any directives to drop the charges.

Mokaya had previously requested a review of the charges and sought clarification on whether President William Ruto would be called to testify. However, during a court session on Wednesday, the prosecution stated that no instructions for case withdrawal had been given. As a result, the court scheduled the full hearing for May 29, 2025.

His legal counsel, Danstan Omari, argued that the case revolves around citizens' right to critique their leaders, including the President. The Law Society of Kenya (LSK) also raised concerns, questioning the case's jurisdiction and inquiring whether President Ruto would appear as a witness.

According to the prosecution, Mokaya, under the X account "Landlord @bozgabi," allegedly posted an image on November 13, 2024, falsely suggesting it depicted President Ruto’s body being transported from a funeral home.

The image showed a casket draped in the Kenyan flag, accompanied by military officers in ceremonial attire.

The authorities claim the post was deliberately misleading, creating a false narrative involving the President.
