A dramatic twist unfolded in a high-profile murder case on Wednesday involving a United Democratic Alliance (UDA) official, when one of the accused allegedly threatened to kill a state prosecutor during a court session.

Ebel Ochieng Kalo, a board member of the Lake Basin Development Authority (LBDA) and a senior UDA figure, is currently in custody over the assassination of Kasipul MP Charles Were.

During his appearance before Justice Diana Kavedza at the Milimani Law Courts, Kalo reportedly issued death threats to Allen Mulama, a prosecutor from the Office of the Director of Public Prosecutions (ODPP), after the prosecutor objected to his release on bond.

The threat—"huyu tutamuua" (we will kill him)—shocked the courtroom, prompting Mulama to immediately leave the proceedings. In response, Justice Kavedza ordered heightened security in court and denied bail for all three suspects involved in the case. She also directed that Kalo be taken to Mathari Hospital for a mental health evaluation, while the third suspect be placed in isolation at Nairobi Remand Prison until assessment results are received.

The court scheduled the next mention of the case for June 17, with the prosecution urging swift and decisive intervention.

In a related development, Justice Margaret Muigai, presiding over a separate virtual session, ordered two additional suspects—Isaack Kuria and Allan Omondi Ogolla—to undergo mental evaluation before formal murder charges are filed. They are to be detained at Kamiti Maximum Security Prison and provided with legal representation.

MP Charles Were was fatally shot on April 30, 2025, at the City Mortuary roundabout in Nairobi. Police say a gunman on a motorbike opened fire at close range.

Key suspects include Were’s own driver and bodyguard, believed to be part of a larger assassination plot.
