Former interior cabinet secretary Fred Matiang'i will appear at the Directorate of Criminal Investigations headquarters on February 24 or face legal action.

Dr Matiang'i is to assist the State in its investigations into the former CS on claims of false information violating Section 23 of the Computer Misuse and Cyber Crimes Act 2018, according to the summons issued by detective Michael K. Sang of the DCI's Serious Crime Unit.

The notification also states that additional offences to the purported raid and entry into Dr Matiang'i's home allegedly occurred from the evening of February 8 to the early morning of February 9.

The summons stated, "I have grounds to think that you, Dr Fred Matiang'i, the former Cabinet Secretary, Ministry of Interior and National Coordination, is connected to the offence or have knowledge that can aid my investigations."

This development comes two weeks after Dr Matiang'i claimed that the former Interior Cabinet Secretary's home was in the raid by a multi-agency team that included the DCI and the Ethics and Anti-Corruption Commission through his attorney Danstan Omari and a group of politicians led by former Prime Minister Raila Odinga.

There are protocols to summon, arrest, question, and even prosecute someone in court. Not all of our home invasions take place at night. It turned out that there had been no raid, so perhaps the former CS had been uneasy. I can confidently tell that no police officer visited the former CS's home," CS Kindiki said in an interview on Monday.

When asked about the summons issued for his client, Mr Omari stated that he was still in contact with the former CS and was awaiting his instructions regarding whether they should go to court to contest the summons quickly.

It occurred on the same day that the DCI's attempt to call Mr Omari in connection with allegations that the police raided Matiang's home was rejected by the court after Justice Ngaah gave the attorney permission to contest the validity of the summons.

A prohibition against police arresting Dr Matiang'i has been extended by the High Court in Milimani, Nairobi, until April 19.
