The Milimani anti-corruption court has permitted the DPP to drop a Ksh—one hundred sixty-seven million NYS lawsuit against former Youth and Gender PS Lillian Omollo.

The 12 allegations of abuse of office and conspiracy to conduct an economic crime were dropped due to the application.

Following testimony from witnesses who could not directly or indirectly link the former PS, the motion to withdraw the lawsuit was made under Section 87(a) of the Criminal Procedure Code.

"I therefore allow the withdrawal of the charges under Section 87 of the Criminal Procedure Code (CPC) after evaluating the request by the prosecution and since the same is not opposed by Omollo," Onyina said.

According to court records, the erroneous payments were paid well before the PS took the oath of office.

However, the prosecution of Ngirita and the other defendants will go forward.
