The Orange Democratic Movement (ODM) has been temporarily barred from expelling Kisumu Senator Tom Ojienda and MPs Elisha Odhiambo and Felix 'Jalang'o' Odiwuor.

The orders issued by the Political Parties Disputes Tribunal on Tuesday are pending the hearing of a petition filed on Monday appealing the trio's expulsion based on alleged violations of the party's constitution.

According to the court documents, "In the interim and pending the hearing and determination of this Application, this Honourable Tribunal hereby issues interim conservatory orders staying the implementation and/or execution of the 1st Respondent's decision to expel the Complainant/Applicant, Hon. Phelix Odiwuor Kodhe, from the Orange Democratic Movement Party,"

The topic has been scheduled for discussion on September 25.

Last Wednesday, Ojienda, Odhiambo, and Jalang'o were removed from the party, along with Caroli Omondi (Suba South) and Gideon Ochanda (Bondo).

They were charged with breaking the ODM constitution and the Political Parties Act 2011 by publicly associating with and supporting the operations of a rival political group's operations and rejecting legal decisions made by party organs.

On Friday, ODM leader Raila Odinga defended the expulsion during a meeting with Migori County ODM delegates, saying the party can only be powerful if its members are united and disciplined.

After his expulsion, jalango posted a cryptic bible verse, He wrote: “No trial is too heavy to lift! No temptation has overtaken you that is not common to man. God is faithful, and he will not let you be tempted beyond your ability, but with the temptation he will also provide the way of escape, that you may be able to endure it. Corinthians 10:13.”
