The Kenya Teachers in Hardship and Arid Areas Welfare Association (KETHAWA) has banned the Teachers Service Commission (TSC) from sending displaced teachers back to their former locations. The Employment and Labour Relations Court made this decision.

Under a certificate of urgency, KETWAHA had petitioned the court to prevent TSC from moving the teachers above back to their old dockets in the North Eastern area until their case was resolved.

In an affidavit sworn by KETHAWA National Secretary Wangonya Wangenye, the teachers decried discrimination and violation of fundamental rights and freedoms by TSC, which interdicted and subjected them to disciplinary action following their ascension of duty.


Later, TSC sent them reposting letters demanding they return to the North Eastern counties where they had previously lived.

Judge B.O. Manani directed TSC not to reassign the teachers to their prior positions when he handed down the decision on Friday.

"It is hereby ruled that pending the hearing and determination of the application inter-parties , an order is hereby issued prohibiting the 1st respondent from reposting the teachers who are members of the applicant herein to NORTH EASTERN KENYA where they fled from due to insecurity," court documents seen by Citizen Digital read in part. 

TSC was similarly instructed to refrain from taking disciplinary measures against the KETWAHA teachers. 

"It is hereby ruled that pending the hearing and determination of the application inter-parties, an order is hereby issued restraining the respondents from taking disciplinary action against the applicant 's members on the basis of the matters that form the basis of the grievance under inquiry," adds the court.


After the court's ruling, Wangonye applauded, stating, "We thank the courts for upholding justice to the teachers who flew North Eastern region due to insecurity."
