The petition, submitted by Julius Ogogoh through the Commission for Human Rights and Justice, contends that appointing these four individuals to Cabinet roles would create a conflict with the opposition's constitutional duty to oversee the government.

The petition argues that, as members of the official opposition coalition in the National Assembly, the nominees have a constitutional obligation to monitor and scrutinize the actions of the Executive and other branches of government.


Appointing them to Cabinet positions, the petition asserts, would undermine this oversight role, as it is the responsibility of the opposition party, as mandated by the people of Kenya and the constitution, to provide checks and balances on government actions.
