The highlighting of submissions in the bizarre incident where baby Junior Sagini’s eyes were gouged out has been rescheduled for May 31.
Kisii Senior Resident Magistrate Christine Ogweno directed the prosecution and victim’s counsels to file their final submissions within seven days by highlighting the case next week.
The three accused persons, Pacifica Nyakerario, Alex Ochogo, and Rael Mayieka, appeared before the court while mentioning the case on Thursday morning for further directions.
Advocate George Morara, representing baby Sagini, noted the matter was supposed to be heard on May 26 but could not proceed due to challenges on the side of the counsels representing both parties.
Morara said the prosecution and defence are expected to highlight the facts in the case next week through the evidence and witnesses presented in court and rule whether the three accused persons are guilty of causing grievous harm to baby Sagini.
Advocate Davine Biyaki's counterpart expressed confidence in the case, saying they were working on their submissions to ensure that the court finds the accused persons guilty of the charges labelled against them.
Baby Sagini was found in a maize plantation with his eyes plucked out at Ikuruma village, Marani Sub County, on December 14, 2022, and rushed to Kisii Eye Hospital for treatment.
The boy had gone to fetch water from a nearby stream accompanied by other children but abandoned them and failed to return home, prompting his family to begin searching for him.
The three-year-old and his sister are under state protection and recuperating well, as told by the legal team.
