The appointment of Peter Mathuki, the secretary general of the East African Community (EAC), as Kenya's ambassador to Russia is under scrutiny in a petition submitted to the East African Court of Justice (EACJ). 

Hassan Male Mabirizi, a Ugandan attorney, contends that the appointment of Mathuki as Kenya's president violates and disregards articles 6(d), 7(2), and 67(4) of the treaty for the establishment of the East African Community.

Mabirizi continues, "Mathuki has not yet finished his fixed five-year term since taking over the EAC job in May 2021."

Ruto appointed Mathuki as Kenya's envoy to Russia last week.


The petitioner claims that his action undermines the community's secretary general position by reducing the president to the status of an ambassador.

In addition to declaring Ruto's position void, he requests that the court impose a permanent injunction to prevent Kenya from making the decision before Mathuki's appointed term ends.
