Judge Grace Nzioka of the High Court has closed an appeal brought by the Director of Criminal Investigations (DCI) and the Director of Public Prosecution (DPP) against Joshua Waiganjo, who was charged with posing as a police officer. 

This follows the Court of Appeal's ruling that the High Court's retrial order was improper and illegal under the circumstances. 

The judge declared the case closed after noting that events had taken precedence over the appellate court's ruling.


"This matter is overtaken by events and is therefore closed," the court noted.

The appellate court ruled that Waiganjo's charges should be dropped and that, barring an illegal hold, he should be released immediately. 

In 2020, Waiganjo was found not guilty of posing as a senior police officer. It was claimed that between June and December of 2012, he had assumed the identity of an assistant police officer on several occasions.
